Cylinder ownership and use

Any cylinders supplied to you by Flogas Britain Limited, its distributors or dealers (“Flogas”) as part of this purchase of Gas (“Agreement”), which are used for the storage of liquefied petroleum gas (“Gas”) together with all ancillary valves, guards, regulators and other items used in connection with them (the “Cylinder(s)”):

1. Remain the property of Flogas Britain Limited and you will not part with possession of the Cylinders, save in exchange for full Cylinder(s) from Flogas;
2. Must only be used with Gas supplied by Flogas and no other Gas;
3. Will be kept by you in good condition in accordance with any instructions for use, handling and storage provided by Flogas; and
4. Must be returned to Flogas after they are empty of Gas, or if you no longer wish to utilise the Gas or the Cylinders, or you are asked to do so by Flogas.

Customer responsibilities

By accepting the Cylinders, you agree that:

1. You will allow Flogas at all reasonable times and without prior notice to access the premises where the Cylinder(s) are kept from time to time in order that they may inspect, test or replace the Cylinder(s); and
2. You will be fully responsible for any and all loss, claims, demands or expenses arising out of or resulting from:

• Any damage to your property or to the property of Flogas or third persons;
• Personal injury to you or to Flogas or third persons, save where such injury results from the negligence of Flogas occasioned by the use of the Gas;
• Damage to the Cylinder(s);
• The existence of Gas or the Cylinder(s) on your property/premises; or
• Any failure by you to fulfil your obligations to Flogas or otherwise arising from or attributable to the same.

Without limiting the generality of the foregoing, in the case of damage to the Cylinder(s) of such a nature that they cannot be easily repaired, Flogas may charge you for the costs of replacing the Cylinder(s) and may retake possession of the Cylinder(s) and for such purpose.

Credit and adverse media checks

Please note this Agreement is conditional upon Flogas receiving satisfactory credit and adverse media checks in respect of the Buyer.

By entering into this Agreement, you consent to Flogas undertaking such checks and, if applicable, disclosing the Buyer’s personal information to credit reporting and adverse media checking agencies.

Flogas may terminate this Agreement at any time should such satisfactory credit and adverse media checks be considered unsatisfactory to Flogas.
