The following terms and conditions apply to all competitions, prize draws, votes and polls promoted by the Flogas Britain Limited whose office is: Watermead Business Park, Rayns Way, Syston, Leicester LE7 1PF (the Promoter) in any media including without limitation flyers, mailings, online or mobile media.

These terms and conditions apply in addition to any specific terms and conditions which may be mentioned in any promotion of or messages about that competition, prize draw, vote or poll in any media (Specific Conditions). Together these general terms and conditions and the Specific Conditions shall be referred to as the “terms and conditions”. To the extent that there is any inconsistency between these general terms and conditions and the Specific Conditions, the Specific Conditions will prevail.

All persons who take part in the competition will be deemed to have accepted these terms and conditions. If you do not agree with any of the terms and conditions then you should not take part in the competition, prize draw, vote or poll (as applicable).

Duration:

The competition will close on the date stated on the publicity material at 1pm, (GMT time) (Closing Date). There will be one winner. After 1pm on the Closing Date, no further entries to the competition will be permitted. No responsibility can be accepted for entries not received before 1pm on the Closing Date for whatever reason.

Who can participate:

This competition is open to people based in the UK aged 18 years and over. Employees of the Promoter or their family members of such Employees or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition. The competition is free to enter. The Promoter may require you to provide proof that you are eligible to enter the competition.

The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

The Promoter will not accept competition entries that are:

(a) automatically generated by computer;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with;

(d) photocopies and not originals; or

(e) incomplete.

The prize:

The prize will be as detailed on the promotional material. Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value. The prize is not negotiable or transferable.

Winners:

The Promoter will announce the winners on the closing date via email as soon as possible after the draws take place. The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered.

The Promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of Force Majeure including anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s control. Any changes to the competitions will be notified to entrants as soon as possible by the Promoter.

The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 30 of days of the announcement of the winner, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

The Promoter does not accept any responsibility if you are not able to take up the prize.

Jurisdiction:

The competition and these terms and conditions will be governed by the laws of England unless the entrant to a competition or prize draw, or the participant in a vote or poll is a Scottish or Northern Irish resident in which case he/she may choose the law of their residence and they irrevocably submit to the exclusive jurisdiction of the courts of England and Wales again unless the entrant to a competition or prize draw, or the participant in a vote or poll is a Scottish or Northern Irish resident in which case they may choose the courts of their residence in Scotland or Northern Ireland.

Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

Ownership of competition entries and intellectual property rights

All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

By submitting your competition entry and any accompanying material, you agree to:

(a) assign to the Promoter all your intellectual property rights with full title guarantee; and

(b) waive all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

You agree that the Promoter may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.]

In addition, the winner agrees to the use of his/her name and image in any publicity material. Any personal data relating to the winner, or any other entrants will be used solely in accordance with current data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

General

If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
